WHAT IS USHR?

The Zakat paid on the produce of a crop grown for the purpose of obtaining profit from the land is called Usher.

* In a field that is irrigated with water from rain, canals, or drains (without paying a price), Usher, i.e. one-tenth, is obligatory.

* In a field that is irrigated with a bucket (or one's own tube well), etc., half-Usher, i.e. one-twentieth, is obligatory.

* If water (from a canal or tube well, etc.) is purchased for irrigation, i.e. the water is purchased from someone who owns it, then half-Usher is obligatory.

* If that field is irrigated with rain water some days and with buckets (or one's own tube well), etc., then if rain water is used most of the time and sometimes with buckets (or one's own tube well), etc., then Usher is obligatory. Otherwise, half-Usher is obligatory.

When the produce is harvested, i.e. the crop ripens or the fruits come out and are capable of yielding profit, Usher will become obligatory. After harvesting or picking fruit, the tithe must be calculated and paid.

                   

عشر کیا ہے؟   

زمین سے نفع حاصل کرنے کی غرض سے اُگائی جانے والی شے کی پیداوار پر جو زکوٰۃ ادا کی جاتی ہے اسے عشر کہتے ہیں

٭ جو کھیت بارش ، نہر ، نالے کے پانی سے (قیمت اداکئے بغیر)سیراب کیا جائے ، اس میں عشر یعنی دسواں حصہ واجب ہے

               ٭ جس کھیت کی آبپاشی ڈول (یا اپنے ٹیوب ویل )وغیرہ سے ہو ، اس میں نصف عشر یعنی بیسواں حصہ واجب ہے 

٭ اگر (نہر یا ٹیوب ویل وغیرہ کا)پانی خرید کر آبپاشی کی ہو یعنی وہ پانی کسی کی ملکیت ہے اس سے خرید کر آبپاشی کی ،    جب بھی نصف عشر واجب ہے ،

٭ اگر وہ کھیت کچھ دنوں بارش کے پانی سے سیرا ب کر دیا جاتا ہے اور کچھ دن ڈول (یا اپنے ٹیوب ویل )وغیرہ سے ، تو اگر اکثربارش کے پانی سے کام لیا جاتا ہے اور کبھی کبھی ڈول (یا اپنے ٹیوب ویل ) وغیرہ سے تو عشر واجب ہے ورنہ نصف عشر واجب ہے

جب پیداوار حاصل ہوجائے یعنی فصل پک جائے یا پھل نکل آئیں اورنفع اٹھانے کے قابل ہوجائیں تو عشر واجب ہوجائے گا فصل کاٹنے یا پھل توڑنے کے بعد حساب لگا کر عشر ادا کرنا ہوگا ۔

HOW TO CALCULATE USHR?

Ushr is for the whole produce without deducting its expenses, so even if the expenses of seeds, fertilizers, pesticides etc. are more than the produce, and nothing is left for the landlord and farmer, Ushr will be still be compulsory for the whole harvest. Deducting the expenses from this will not be allowed.

عشر تمام پیداوار کے لیے ہے، اس کے اخراجات کو کم کیے بغیر، لہٰذا اگر بیج، کھاد، کیڑے مار ادویات وغیرہ کے اخراجات پیداوار سے زیادہ ہوں اور زمیندار اور کسان کے لیے کچھ بھی باقی نہ رہے تب بھی عشر پوری فصل پر واجب ہوگا۔ اس سے اخراجات کم کرنے کی اجازت نہیں ہوگی۔

Note: For mixed irrigation, Islamic scholars state that: If natural irrigation is the predominant method (used more often or provides the majority of the water), the 10% rate applies. If artificial irrigation is the predominant method, the 5% rate applies. Some contemporary interpretations allow for a weighted average if the usage is exactly 50/50, which would result in a 7.5% rate (the average of 5% and 10%). However, the primary classical ruling is to use the rate of the predominant method.
